Guest Indemnity, Waiver of Liability & Assumption of Risk

This document is intended for guests staying at Ngoma Bush Lodge and participating in lodge activities including game drives, bush walks, transfers, excursions, and wildlife experiences.

1 Acknowledgement of Risk

I / We acknowledge and understand that:

• Ngoma Bush Lodge is situated in a natural bush and wildlife environment in Hoedspruit, Limpopo, South Africa.
• Participation in safari activities, game drives, bush walks, transfers, excursions, and general movement around the lodge takes place in a natural environment where risks may include, but are not limited to:
  • Wild animals, plains game, reptiles, snakes, spiders, scorpions, insects, birds, ticks, and mosquitoes
  • Allergic reactions to plants, insects, animals, food, or environmental conditions
  • Uneven ground, loose stones, slippery surfaces, thorns, branches, and natural obstacles
  • Open water areas where applicable
  • Fire, smoke, storms, lightning, extreme heat, and sun exposure
  • Dehydration, malaria, tick-bite fever, and other health risks associated with a bush environment
  • Limited access to immediate medical care due to the remote location
  • Vehicle incidents during game drives, transfers, or excursions
  • Risks associated with walking in bush areas
  • Risks associated with third-party safari, transfer, and excursion operators
• I / We voluntarily enter the property and participate in lodge activities with full knowledge of the inherent risks of a natural bush and safari environment, while understanding that Ngoma Bush Lodge remains responsible for taking reasonable care as required by South African law.
• I / We acknowledge that wildlife is unpredictable and that no absolute guarantee of safety can be given at any time.

2 Release of Liability

I / We hereby waive, abandon, and renounce any claim of whatsoever nature against:

NGOMA BUSH LODGE (PTY) LTD

(its owners, directors, employees, guides, staff members, contractors, agents, representatives, affiliated partners, and landowners)

for any injury, illness, loss or damage to property, emotional distress, delays or interruptions, or death arising directly or indirectly from accommodation, participation in any activity, transportation, game drives, bush walks, excursions, or use of lodge facilities — subject to the limitations of South African law as noted in the Important Legal Notice above.

3 Indemnity

I / We indemnify and hold harmless the Indemnified Parties against any claims, damages, costs, legal expenses, or liabilities brought by myself, family members, dependants, guests, minors under my supervision, or executors or representatives, to the extent permitted by South African law.

4 Guest Responsibilities

I / We agree to:

• Follow all lodge rules, safety briefings, signage, and instructions given by Ngoma Bush Lodge management, staff, guides, drivers, or authorised representatives.
• Not approach, feed, touch, chase, disturb, or provoke any animals.
• Not walk alone in restricted bush areas unless permitted by lodge staff.
• Remain seated during game drives or transfers unless instructed otherwise.
• Keep a safe distance from wildlife and natural hazards at all times.
• Exercise reasonable care for my / our own safety and the safety of others at all times.

Failure to follow safety instructions may result in injury, removal from an activity, or removal from the property without refund.

5 Medical Disclosure and Emergency Treatment

• I / We confirm that I / we have disclosed any medical condition, allergy, disability, pregnancy, medication requirement, or other health concern that may affect participation in lodge activities.
• I / We understand that I / we remain responsible for bringing and safely using any personal medication required during my / our stay.
• I / We acknowledge that medical facilities in remote safari areas may be limited or delayed.
• In the event of illness, injury, accident, or emergency, I / we authorise Ngoma Bush Lodge and its representatives to arrange medical assistance, emergency transport, evacuation, hospital care, or other treatment considered reasonably necessary.
• I / We accept that all medical, evacuation, rescue, hospital, transport, and related costs will be for my / our own account.

6 Travel and Medical Insurance

Ngoma Bush Lodge strongly recommends that all guests arrange suitable travel insurance, medical insurance, evacuation cover, and cover for personal belongings, cancellation, delays, and third-party activities before arrival. Ngoma Bush Lodge does not provide any insurance cover on behalf of guests.

7 Personal Belongings

Guests remain responsible for their own personal belongings, valuables, cash, passports, cameras, phones, electronics, luggage, and documents. Ngoma Bush Lodge will take reasonable care but shall not be responsible for loss, theft, or damage unless caused by gross negligence or wilful misconduct. Guests are advised not to leave valuables unattended.

8 Minors

Ngoma Bush Lodge does not accept children under the age of 14. The signing adult accepts full responsibility for any minor aged 14 to 17 accompanying them and confirms that they are legally authorised to sign this indemnity on the minor's behalf.

9 Third-Party Activities and Services

I / We understand that certain activities or services may be provided by independent third-party operators, including but not limited to Big 5 safaris, transfers, excursions, tours, activities, or other services arranged on request.

Ngoma Bush Lodge may assist with bookings or arrangements, but such third-party operators remain independent service providers. I / We understand that their own terms, conditions, indemnities, and safety rules may apply directly between myself / ourselves and the third-party operator.

10 Protection of Personal Information (POPIA)

I / We consent to Ngoma Bush Lodge collecting and processing the personal information provided in this form, including identification details, contact details, booking details, emergency contact details, medical information, and signature.

This information will be used for guest registration, safety, emergency assistance, legal compliance, insurance purposes, lodge administration, and communication relating to my / our stay.

Ngoma Bush Lodge will take reasonable steps to protect this information and will not share it unnecessarily, except where required by law, emergency services, insurers, service providers, or third-party operators directly connected to my / our stay.

11 Governing Law

This agreement shall be governed in accordance with the laws of the Republic of South Africa. Any disputes arising from this agreement shall fall under the exclusive jurisdiction of the South African courts.

12 Severability

If any clause or part of this indemnity is found to be invalid, unlawful, or unenforceable, the remaining clauses shall remain valid and enforceable to the fullest extent permitted by law.
